"It would be best for the departing U.S. administration to annul the decision to recognize the phony state, or for the new administration to do it immediately after the November presidential elections," said Kostunica's adviser Branislav Ristivojevic.

The the court which could be chosen for the Serbian case against the U.S. has not been revealed yet, but the International Court of Justice in The Hague is the UN's highest court to deal with disputes between states.

"If the US annuls this illegal decision, Serbia would withdraw the charges. Otherwise, we will file suits against America before all international courts," Ristivojevic said.

Belgrade will also sue all other countries which recognize Kosovo's unilateral secession.
